Drug Driving


Since 2015 there have been two ways that you can be prosecuted for ‘drug driving’:


  • Driving whilst unfit through drugs; and
  • Driving with excess (over the specified legal limit) drugs

Driving whilst unfit through drugs

It is an offence under s. 4(1) of the Road Traffic Act 1988 to drive or attempt to drive a mechanically propelled vehicle on a road or other public place while being unfit to do so through drink or drugs. A person shall be considered to be unfit to drive if his ability to drive properly is for the time being impaired.

Driving with excess (over the specified legal limit) drugs

It is an offence under s. 4(1) of the Road Traffic Act 1988 to drive or attempt to drive a mechanically propelled vehicle on a road or other public place while being unfit to do so through drink or drugs.
